I. GENERAL TERMS
a) My Investing Club provides information for educational purposes only.

b) Our services, including, but not limited to, live trading demonstrations, are not meant to be a recommendation to buy and/or sell securities.

c) My Investing Club (and its owners, operators, employees, shareholders, and members) are NOT registered broker/dealers nor investment advisers.

d) My Investing Club (and its owners, operators, employees, shareholders, and members) are not qualified to give the Member financial advice.

e) Investing and trading in financial securities carry a high degree of risk. The Member should do their own due diligence in any investments the Member makes.

f) This website and any live trading that we stream is for educational, informational, and entertainment purposes only. The Member should contact their financial adviser before taking part in any trading or investing activities. The Member should never invest in a stock mentioned within our service unless the Member can afford to lose their entire investment.

g) We reserve the right to buy and sell shares of any company mentioned on this website at any time.

h) We will not be liable to any person or entity for the accuracy, completeness, reliability, quality, or timeliness of the information provided on this website, or for any direct, indirect, consequential, incidental, special, or punitive damages that may arise out of the use of information we provide to any person or entity (including, but not limited to, lost profits, loss of opportunities, trading losses, and damages that may result from any inaccuracy or incompleteness of this information).

i) The Member acknowledges that investing in securities involves risk and that the Company makes no guarantee or promise of profitability or particular performance results. The Member further acknowledges that past performance is not indicative of future results.

j) The Member understands that any fees charged as a result of the Member using the Company’s services are strictly non-refundable, and may not be disputed with the Member’s credit card. All sales are final.

II. RELEASE OF LIABILITY
a) The Member agrees that My Investing Club (and its owners, operators, employees, shareholders, and members) WILL NOT be held responsible for any and all losses (monetary or otherwise), damage (monetary or otherwise), or injury (monetary or otherwise) that the Member or any third party may incur as a result of using our website or any of our services including (but not limited to) the live desktop stream, chat room, YouTube videos, blog content, or any other My Investing Club property. The Member agrees to completely release us from ANY and ALL liability for any type of losses or damages (monetary or otherwise) that the Member or any third party may incur from the Member’s use of our services, websites, or in trading financial securities.

b) Our watchlists (videos or text), educational videos, chat room messages, live desktop stream, social media posts, and any/all other My Investing Club services are for informational purposes only. Neither the information presented nor any statement or opinion is guaranteed or warranted by us to be accurate and should not be taken as a complete statement or summary of the available data. My Investing Club is not responsible for errors or omissions. My Investing Club may have a position (buying or selling stock) in the securities mentioned and may buy or sell such positions without notice. Any and all opinions and data expressed are subject to change without notice.

c) The Member understands and agrees that the content and services included or obtained on this site MAY NOT be accurate, it is presented “as is” and we hold no warranties of any kind on information we share or post on the My Investing Club website or elsewhere.

III. PRIVACY
a) The Member agrees to respect the privacy of other members and mentors. The Member will not disclose any sensitive information shared during live trading sessions to any third parties without prior written consent from the Company.

b) Any information presented during live trading sessions is strictly confidential between the Member and the Company only.

IV. PROHIBITION OF UNAUTHORIZED RECORDING
a) The Member agrees not to record, reproduce, distribute, or stream any part of the live trading sessions without the explicit written permission from the Company, which may be withheld at any time and for any reason.

b) The Member understands that any violation of this provision or any other provisions of this Agreement may result in immediate termination of their membership and potential legal action.

V. MISCELLANEOUS TERMS
a) This Agreement and the rights and obligations hereunder shall be binding upon and inure to the benefit of the Parties hereto and their respective successors and assigns.

b) No waiver or indulgence of any breach or series of breaches of this Agreement shall be deemed or construed as a waiver of any other breach of the same or any other provisions hereof or affect the enforceability of the remainder of this Agreement; and in any event, no waiver shall be valid unless executed in writing.

c) Each party shall bear their own attorneys’ fees and costs as part of this Agreement. This Agreement shall be governed by California law and any dispute arising hereunder shall be venued in the Los Angeles Superior Court. In the event litigation arises from this Agreement, the prevailing party shall be entitled to its reasonable attorney’s fees and costs.

d) Each party hereto acknowledges and represents that they (a) have fully and carefully read this Agreement prior to execution; (b) have been, or have had the opportunity to be fully apprised by their attorney of the legal effect and meaning of this document and all the terms and conditions hereof; (c) have had the opportunity to make whatever investigation or inquiry deemed necessary or appropriate in connection with the subject matter of this Agreement; (d) have been afforded the opportunity to negotiate as to any and all terms hereof; and (e) are executing this Agreement as a free and voluntary act.

e) The failure of any Party at any time to require performance of any provision of this Agreement shall not limit that Party’s right to enforce the provision, nor shall any waiver of any breach of any provision constitute a waiver of that provision itself.

f) The provisions hereof are not intended for the benefit of any third party, but solely for the Parties to this Agreement.

g) This Agreement may be executed in multiple counterparts, all of which shall be deemed originals, and with the same effect as if all Parties had signed the same document. All of such counterparts shall be construed together with and shall constitute one Agreement, but in making proof, it shall only be necessary to produce one such counterpart. A facsimile or email transmission shall be as valid and enforceable as an original.

h) Any notices to be given hereunder may be given by email.

VI. TERMINOLOGY
a) For the purposes of this Agreement, the phrase “The Member” is also meant to include “The Subscriber or purchaser of the subscription.”
